Child Safety Standards1. Provider and Scope
These Terms and Conditions apply to the use of the dating app TheLastFirst and all related services, content and features.

These Terms apply to all users of TheLastFirst. Any deviating terms of users shall not apply unless the provider has expressly agreed to their application in writing.
TheLastFirst is initially offered in Germany. The app may be made available through mobile platforms such as Android and iOS. For downloads, in-app purchases and subscriptions, the terms of the respective app store may apply in addition to these Terms.
2. Description of the App
TheLastFirst is a dating app for adults. The app enables users to create a personal profile, discover other profiles, express interest and receive a match if both users show mutual interest.
After a match, users may communicate with each other within the app. TheLastFirst provides features such as text chat messages and voice messages. The specific availability of individual features may vary depending on the app version, technical availability and development status.
TheLastFirst does not owe or guarantee any specific outcome. In particular, users have no claim to matches, messages, dates, relationships, a specific number of displayed profiles or a particular quality or duration of contacts.
TheLastFirst may offer both free and paid features. Paid premium features are optional and extend the use of the app, in particular through additional filters or search options.
3. Minimum Age, Registration and User Account
The use of TheLastFirst is permitted only for persons who are at least 18 years old.
During registration, users must provide truthful information. In the first version of the app, registration is carried out with an email address and password. Users must provide their actual date of birth and confirm that they are at least 18 years old.
If the information provided shows that a user is underage, registration is not possible. TheLastFirst may suspend or delete user accounts if there is reasonable suspicion that a user is underage, has provided false information or has violated these Terms.
Each user may only use their own account. The use of third-party accounts, sharing an account with third parties, creating fake profiles and using another person’s identity are prohibited.
Users are responsible for keeping their login credentials confidential and protecting their account from unauthorised access.
4. Profile Content and Location Information
Users may include in their profile, among other things, personal information, photos, location information in the form of a city, languages, interests or profile answers, as well as information about lifestyle, relationship intentions and personal preferences.
Location information is based on manually entered places. Other users may see the city stated in the profile. TheLastFirst does not provide a feature that shares a precise live location with other users.
All profile information must be truthful, lawful and respectful. Profiles must not be misleading, deceptive or unlawful.
5. Likes, Matches, Chats and Voice Messages
Users may discover other profiles and express interest. A match is created when two users have mutually expressed interest in each other.
TheLastFirst follows a deliberately limited dating concept. The app may limit the number of active matches and parallel chats. According to the current feature model, a maximum of three matches and a maximum of one active chat at the same time are provided for.
If users wish to continue a match, a voice message must be sent after a certain period. According to the current feature model, this period is three days. If the required voice message is not sent within the applicable period, the match may be automatically ended.
Ended matches may result in the user no longer being able to continue the chat or further communication with the relevant person.
6. Rules of Use and Prohibited Content
Users must use TheLastFirst respectfully, honestly and lawfully. Profiles, photos, messages, voice messages and other content must not infringe the rights of third parties and must not contain unlawful, deceptive, harassing or dangerous content.
In particular, the following are prohibited:
- fake profiles and false information about one’s own person,
- the use of another person’s identity,
- harassment, insults, threats, stalking or intimidating behaviour,
- spam, fraud, phishing, manipulative or inauthentic use,
- unauthorised commercial advertising, sales, competitions or other promotional use,
- discriminatory content, hate speech, extremist content or content promoting violence,
- unlawful content or content encouraging unlawful acts,
- content that endangers, deceives or specifically exploits other users,
- content that infringes third-party rights, in particular personality rights, copyrights, trademarks or data protection rights,
- uploading or sharing photos or content of other persons without the required consent,
- malware, viruses, automated scripts or other technical manipulation.
Nudity, pornographic content and sexually explicit depictions are prohibited in profile pictures and publicly visible content. Realistic or graphic depictions of violence are also prohibited unless they are clearly news-related or documentary in nature.
Public profile areas must not contain private contact or payment information. In particular, phone numbers, email addresses, addresses, bank details, payment data, external links, Instagram names, social media handles and advertising for the user’s own or third-party social media accounts are prohibited.
7. User Content and Rights of Use
Users generally retain their rights to the content they upload or provide in TheLastFirst, including profile photos, profile texts, profile answers, messages and voice messages.
By uploading or providing content, the user grants TheLastFirst the simple, non-exclusive rights of use necessary to operate the app. These rights are limited to storing, technically processing, displaying, transmitting and making the content available within the app insofar as this is necessary to provide the features, enable communication between users, ensure app security, moderate reported content or enforce these Terms.
The user represents that they have all required rights to the content they provide and that such content does not infringe any third-party rights.
TheLastFirst is not obliged to store user content permanently. Users should back up content that they wish to retain outside the app, provided this is legally permissible and does not infringe the rights of other users.
8. Content of Other Users
Profiles, photos, texts, messages, voice messages and other content of other users may only be used within the intended features of TheLastFirst.
Users do not acquire any rights to content of other users. It is prohibited to copy, save, publish, forward, commercially exploit, distribute outside the app or otherwise misuse content of other users without their consent.
In particular, it is prohibited to use personal information of other users for advertising, spam, harassment, stalking, fraud or any other improper purposes.
9. Prohibition of Technical Manipulation and Automated Use
The app may only be used through the interfaces and features provided by TheLastFirst.
In particular, scraping, crawling, automated extraction of profiles or data, bots, automated registration, automated profile creation, automated messages, manipulation of technical processes, circumvention of access restrictions and any attempt to use or modify non-public areas of the app or technical systems are prohibited.
It is also prohibited to use the app in any way that may impair the security, stability, availability or integrity of the app, servers, databases or other users.
10. Reporting, Blocking and Moderation
Users may block other users and report profiles, chats and profile photos. A chat report covers both text messages and voice messages.
TheLastFirst provides these reporting and blocking features so that users can report allegedly unlawful content, violations of these Terms, harassing behaviour, fraudulent use or other safety-related incidents.
TheLastFirst reviews reported content and user accounts taking into account the circumstances of the individual case. At the start of the app, moderation is generally carried out manually based on user reports. There is no permanent or comprehensive prior review of all content or private communication.
During the review, TheLastFirst may in particular take into account the reported content, the context of use, the severity of the potential violation, previous violations, the impact on other users and legal obligations.
TheLastFirst may remove reported or clearly unlawful content, restrict the visibility of content, warn users, restrict features and temporarily or permanently suspend or delete user accounts. Measures should be proportionate, taking into account the individual case.
In the event of serious violations, repeated violations, security risks, unlawful content, suspected fraud or danger to other users, suspension or deletion may also take place without prior warning.
Where TheLastFirst removes content, restricts features or suspends or deletes an account, the affected user may be informed of the measure in an appropriate manner, unless legal reasons, security interests or third-party rights prevent this.
If a user believes that a suspension, deletion, content removal or other moderation measure was made in error, they may contact TheLastFirst using the contact address stated in the legal notice and request a review. The request should identify the affected account, the measure and the reasons why the user considers the decision to be incorrect. There is no entitlement to restoration of the account, content or access.
Users must not misuse reporting or complaint features. Clearly unfounded, repeated, malicious or abusive reports may themselves be treated as a violation of these Terms.
11. Dating Safety
Users are solely responsible for deciding whom they communicate with, what information they share and whether they meet other users outside the app.
TheLastFirst does not conduct general identity checks, background checks or criminal record checks on users. TheLastFirst does not warrant the accuracy of user information, the intentions of other users or the success of any contact.
Users should not prematurely share sensitive personal data, payment details or other confidential information with other users. Meetings outside the app should be arranged carefully, voluntarily and in a safe environment.
Suspicious, harassing, dangerous or unlawful behaviour should be reported using the reporting features provided in the app.
12. Premium Features, Prices and App Store Terms
TheLastFirst may offer optional premium features. Premium extends the use of the app, in particular through additional filters or search options. The basic features of the app may remain usable without Premium.
The Premium offer is a monthly, automatically renewing subscription. The current price is EUR 4.99 per month. The price displayed in the respective app store at the time of purchase is authoritative.
Premium is generally activated immediately after a successful purchase.
The conclusion, payment, renewal, management and cancellation of Premium are handled through the respective app store. On Android, this is Google Play; on iOS, this is the Apple App Store. In addition to these Terms, the applicable terms, payment rules and subscription terms of the respective app store apply.
Premium automatically renews for a further billing period unless the subscription is cancelled through the respective app store before the end of the current period.
After cancellation, Premium remains active until the end of the already paid billing period. Access to the Premium features ends thereafter.
TheLastFirst does not offer a free trial period or discount period unless expressly displayed otherwise in the respective app store.
13. Cancellation of Premium and Refunds
A Premium subscription must be cancelled through the subscription management of the respective app store. Deleting the user account, deleting the app or not using the app does not automatically cancel an existing Premium subscription.
Refunds, withdrawal requests or refund requests for purchases made through an app store are generally handled through the respective app store. The procedures and terms of that app store apply. Statutory consumer rights remain unaffected.
Payment, billing and subscription data processed through Google Play or the Apple App Store are not directly managed or deleted by TheLastFirst but are subject to the processes of the respective app store.
14. Account Deletion and Data Deletion
Users may delete their account at any time in the app under “Settings → Delete account”.
When the account is deleted, the personal data associated with the user account is deleted from the active system of TheLastFirst. This includes in particular profile data, profile photos, profile answers, likes, matches, messages, voice messages, language settings and other app data associated with the account.
If a user deletes their account, the matches, chat messages and voice messages associated with that account are also deleted. As a result, this content may no longer be visible to other users.
A Premium subscription concluded through Google Play or the Apple App Store is not automatically cancelled by deleting the user account. The subscription must be cancelled separately through the subscription management of the respective app store.
Data processed outside TheLastFirst, in particular through Google Play or the Apple App Store, or data that must be retained for legal reasons, remains unaffected by the deletion of the user account.

15. Availability, Technical Changes and Push Notifications
TheLastFirst endeavours to operate the app reliably. However, uninterrupted, continuous or error-free availability cannot be guaranteed.
The app may be temporarily restricted or unavailable in particular due to maintenance, updates, technical disruptions, security measures, further development or events beyond the control of TheLastFirst.
TheLastFirst may further develop, modify, expand, restrict or remove features of the app where this is necessary or appropriate for operation, security, technical development or improvement of the app. Users will be informed of material changes in an appropriate manner.
TheLastFirst may use push notifications or similar notices to inform users about app-related events, matches, messages, reminders, security information or feature notices. Users may disable push notifications through the app settings or the settings of their device.
16. Rights in the App
The app, its design, texts, trademarks, logos, user interfaces, software, databases and other proprietary content of TheLastFirst are legally protected.
Users receive only a personal, revocable, non-exclusive and non-transferable right to use the app within the scope of these Terms and the intended features.
Reproduction, modification, making available to the public, commercial exploitation, decompilation, technical analysis or any other exploitation of the app or its components is prohibited unless legally permitted or expressly authorised by TheLastFirst.
17. Liability
TheLastFirst is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions.
In the event of a slightly negligent breach of essential contractual obligations, TheLastFirst is liable only for the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance users may regularly rely.
In all other respects, liability is excluded to the extent permitted by law.
TheLastFirst is not liable for the conduct of users, the accuracy of user information, user content or damages resulting from users’ own interactions with each other, unless TheLastFirst is legally responsible for such damages.
Liability under the German Product Liability Act and any other mandatory statutory liability remains unaffected.
18. Term, Suspension and Termination
The user agreement runs for an indefinite period. Users may delete their account and stop using TheLastFirst at any time.
TheLastFirst may suspend or delete user accounts if a user violates these Terms, provides false information, misuses the app, endangers other users or if there is another important reason.
In the event of suspension or deletion, access to the account, matches, chats, content and features may be restricted or terminated.
Suspension or deletion of the user account does not automatically cancel a Premium subscription concluded through an app store. The subscription must be cancelled separately through the respective app store.
19. Changes to These Terms
TheLastFirst may amend these Terms where this is necessary or appropriate due to legal changes, technical development, new features, security requirements, changes to the business model or other objective reasons.
Users will be informed of material changes in an appropriate manner, for example within the app, by email or on the website. Where legally required, TheLastFirst will obtain the users’ consent.
If a user does not wish to agree to amended Terms, they may stop using the app and delete their account.
20. Privacy
Information on the processing of personal data by TheLastFirst is provided in the Privacy Policy.

21. Consumer Dispute Resolution
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
22. Final Provisions
German law applies, unless mandatory consumer protection provisions provide otherwise.
If individual provisions of these Terms are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
The contractual language is German. An English version may be provided. In case of doubt, the German version shall prevail for users in Germany.
